Frequently asked questions
What is the stamp duty rate in Uttar Pradesh?
Uttar Pradesh charges 7 per cent stamp duty on the higher of the transaction value or the circle rate. Where the sole buyer is a woman, a rebate of 1 per cent applies on consideration up to ₹10 lakh, which works out to a maximum saving of ₹10,000. Registration charges are 1 per cent of the value, capped at ₹30,000.
Is stamp duty charged on the agreement value or the circle rate?
On whichever is higher. If the circle rate for the locality exceeds your negotiated price, the sub-registrar computes duty on the circle rate. This is why a below-circle-rate purchase can carry duty higher than 7 per cent of what you actually paid, and why checking the circle rate for the sector matters before you sign.
Does joint ownership with a woman reduce stamp duty?
The UP rebate applies where the buyer is a woman. For joint male-female ownership, treatment has varied by sub-registrar and by circular, so confirm with the registering office for your sector before budgeting the saving. The maximum benefit is ₹10,000 either way, so it should not drive the ownership decision on its own.
Are there other charges beyond stamp duty and registration?
Yes. Expect processing or legal fees, a nominal e-stamping charge, and for apartments a share of society formation or maintenance advance. On under-construction property, GST at 5 per cent without input credit (1 per cent for affordable housing) applies to the construction value and is separate from stamp duty.
